| WILLS AND ESTATE ADMINISTRATION |
|
A Will is a legal document that
allows you to direct the distribution of your property upon death in an
economical and efficient manner. If you die without a Will, the rules of
intestate distribution dictate how your property will be passed. In Texas, your
estate will be encumbered with significant additional legal expenses and delays
in probate court, if you do not have a Will.
At The Hawks Law Firm, we understand Texas Law as it relates to your
Will. For example, we will provide in your will for an Independent Executor of
your choice to administer your estate with a minimum of court supervision and
legal expense. This will make probating your Will a streamlined process.
We here at The Hawks Law Firm also have many years of Estate Planning
experience. Estate planning is the process of ascertaining the appropriate
legal instrument, i.e. Will or Trust for your estate, and what pertinent
provisions to insert in the instrument that will provide the most tax and other
benefits to provide you efficient means to manage and pass your property to your
heirs upon your death.

| BANKRUPTCY |
|
For individuals who cannot pay
their debts - called "debtors" - bankruptcy has two main purposes:
First, bankruptcy operates to give the people who are owed money - called "creditors"
- a fair share of the money that the debtors can afford to pay back. Second,
bankruptcy operates to give the debtors a fresh start, by canceling many of
their debts, through an order of the court called a "discharge."
There are two different ways in which bankruptcy can provide for
payments to creditors and a discharge for debtors - Chapter 7 and Chapter 13:
- In a Chapter 7 bankruptcy, debtors
give up certain property that they own a the time they file the bankruptcy case.
This property is sold by a trustee, who uses the proceeds to pay creditors.
The debtors receive their discharge shortly after the case is filed. In this
way, Chapter 7 debtors are allowed to keep the money that they earn after filing
the bankruptcy case, as well as most other property they obtain after the
filing.
- Debtors in Chapter 13 keep all of
their property, whether or not it is exempt, but they make regular payments on
their debts out of the money that they earn after filing the bankruptcy case.
These payments are made to a trustee who then distributes the payments to the
creditors. The payments are made in regular installments, according to a plan
that the debtor draws up (usually with the help of an attorney).
At the conclusion of an
individual's bankruptcy case, the court enters an order closing the case, and a
copy of this order is sent to the debtor. Unless the trustee has assets to
distribute to creditors, case closing takes place fairly quickly in Chapter 7
cases. In Chapter 13, the case will not be closed until after the debtor
finishes making payments under the plan.
At The Hawks Law Firm, we will walk you through the entire bankruptcy
process, ensuring that you understand the law and how it can work to help you.
We will counsel you concerning whether Chapter 7 or Chapter 13 is the proper
chapter of bankruptcy for you to file under.

| CRIMINAL MATTERS |
|
If you find yourself in trouble
with the law, it is crucial that you understand your rights as they exist under
Texas law. The criminal justice system has three separately organized parts:
the policy; the courts; and corrections, each having a distinct task. However,
these parts are by no means independent of each other. What each one does and
how it does it has a direct effect on the work of the others. At The Hawks Law
Firm, we will guide you through your criminal proceeding, ensuring that you
understand all your rights and options under the law.
